Experience:
Mr. Gearan joined Burns & Levinson in 2007 after participating in the Firm’s Summer Associate Program. He represents businesses and individuals in a wide variety of civil litigation in state and federal courts and in alternative dispute resolution proceedings. Mr. Gearan has extensive experience in all phases of commercial litigation including trial and appellate practice. His practice concentrates on business and commercial law, including contract, business tort, real estate disputes, disputes involving closely held corporations and employment disputes. Mr. Gearan’s labor and employment practice involves advising employers and employees on all aspects of the employment relationship, and litigating cases involving discrimination, wrongful termination, civil rights, sexual harassment, noncompetition, trade secret, and wage and hour compliance.
Significant Cases:
- Tried 14 day bench trial involving dispute over family company and estate assets in Middlesex Superior Court resulting in judgment for approximately $1.1 million
- Obtained favorable summary judgment decision in U.S. District Court, Massachusetts on behalf of female golfer denied right to play in tournament at Massachusetts public golf course. Decision was written about in the New York Times, and other major media outlets
- Successfully drafted and argued opposition to motion for summary judgment in Middlesex Superior Court on behalf of small company, and led subsequent mediation session resulting in large settlement against distributor
- Negotiated favorable settlement at mediation for former employee accused of diverting corporate opportunity

Additional Information:
- While attending Suffolk University Law School, Mr. Gearan also served as a legal intern for U.S. Magistrate Judge, the Honorable Marianne B. Bowler.
- Mr. Gearan served as comment editor for the Suffolk University Law Review.
- Mr. Gearan received the award for Best Staff Competition Piece as a member of the Suffolk University Law Review.
- Mr. Gearan was a member of the 2006 J. Braxton Craven Constitutional Moot Court Team which won the national championship.
- Mr. Gearan was the winner of the 2006 Third Year Day/Fourth Year Evening Trial Competition and a finalist in the 2006 Tom C. Clark Appellate Advocacy Competition at Suffolk University Law School.
- While at Georgetown University, Mr. Gearan served as a speechwriting intern at The White House during the Clinton administration.
