Experience:
Prior to joining Burns & Levinson in January 2006, Mr. Tuttle was a Partner at the firm Perkins Smith & Cohen LLP.
In his securities practice, Mr. Tuttle recently obtained a multi-million dollar award, including punitive damages and interest, on behalf of a client who suffered serious losses due to the mishandling of his employer-issued stock options. Other recent experiences include representing an institutional investor in its claims against a brokerage firm for mishandling the investor's accounts. The Colorado arbitration panel that heard the case awarded damages to the investor and granted its request for attorneys' fees. Mr. Tuttle also represented more than a dozen individual investors in their Massachusetts state court action against a rogue broker and two brokerage firms on claims of securities fraud and asset conversion. He also represented an investor in Wisconsin against a New York brokerage firm, claiming that the firm intentionally churned the investor's accounts, excessively margined his investments, and fraudulently manipulated the markets for certain securities. Mr. Tuttle has conducted numerous NASD, NYSE and AAA arbitrations and mediations involving securities law violations and other claims, and has appeared before the Securities Division of the Secretary of the Commonwealth in securities regulatory actions.
In addition to his securities practice, Mr. Tuttle has handled a wide variety of business, shareholder, insurance and tort litigation matters. He also has represented an inmate on Alabama's death row in habeas corpus proceedings before the federal courts, addressing a range of constitutional issues, and has represented clients in their civil rights claims against government entities and police officers, claiming excessive use of force, false arrest and other constitutional violations.
Significant Cases
• Successfully tried a three-week NASD arbitration to a multi-million-dollar award, including punitive damages and interest, on behalf of a client who had suffered serious losses due to the mishandling of his employer-issued stock options.
• Recovered the substantial losses suffered by a profit sharing plan, through a combination of arbitration, court litigation, and settlements, where the plan had been fraudulently managed by a series of brokerage firms and their registered representative.
• Recovered in excess of $10 million in an ERISA action on behalf of a profit sharing plan where the company sponsor and plan trustees were allegedly involved in fraudulent accounting practices and corporate reporting.
• Successfully represented a number of clients, particularly including older individuals, who were improperly sold and advised to hold unsuitable annuity investments.
• Secured a six-figure arbitration award on behalf of an individual client whose investment accounts and divorce proceeds had been churned and mismanaged by her investment advisor.
