Burns & Levinson's Franchise Group has experience representing both franchisors and franchisees across a broad spectrum of industries and substantive matters. The Franchise Group incorporates a team-oriented, cross-disciplinary approach to ensure our clients receive the necessary levels of expertise required in every aspect of their franchise matters. Franchise Experience
Our attorneys have represented clients in the following areas:
- Advising and counseling regarding rights under contracts and state/federal law, and antitrust concerns of franchise associations
- Advising on, creating and implementing optimal business organization governance and tax structures
- Employment and consumer related issues
- Advising and implementing on disclosures, registration, entity forms and related financing issues and business/personal tax aspects
- Enforcing and defending against non-competition clauses and terminations of franchises
- Perfection and protection of intellectual property rights (IPR) and avoiding infringement of IPR
- Drafting, negotiating and amending franchise and area development agreements, offering circulars and disclosure documents
- Representing parties in litigation over contract rights and related statutory rights
