Throughout his career, Bob has specialized in litigating complex business disputes, including securities litigation and defense of consumer class actions. Bob has previously served as managing partner of a predecessor law firm and as co-chair of Burns & Levinson’s Business Litigation group.

Bob is an experienced advocate and counselor who listens to and evaluates his clients’ goals. He works with clients to select a strategy and dispute resolution process that fits the situation. Bob has tried dozens of lawsuits and arbitrations and engaged in many successful mediations.

Company general counsel, business owners and senior executives rely on Bob to guide them through their complex and often-sensitive business challenges.

Some of the business litigation cases he has tried include consumer class actions, complex litigation involving fiduciaries, product liability, professional liability, insurance coverage, construction/surety, asbestos defense and general commercial litigation.

Bob’s securities practice includes representing broker-dealers, mutual funds and investor groups in federal and state courts; in arbitration, and before regulatory agencies.

Business Litigation

  • Defense and roll up of eighteen consumer class action lawsuits challenging legality of automated traffic violation processing into a single federal proceeding leading to efficient and favorable resolution for traffic services client.
  • Achieved dismissals of three separate putative consumer class action lawsuits alleging contractual, constitutional and consumer protection violations.
  • Summary judgment leading to $7,000,000 recovery for industrial client’s damage to its finished products due to defective chemical additive.
  • Successful defense of public company involving employment based lawsuit brought by former Chairman of the Board.

Securities Litigation

  • Trial to successful judgment for investor group against investment banking firm in a groundbreaking case involving distribution of IPO shares.
  • Successful litigation against mutual fund family challenging excessive advisory fees, leading to substantial changes in calculating advisory fees paid by its mutual fund shareholders.
  • Ongoing representation of mutual fund trustees in claims against 40 Act custodian bank arising out of $16 million fraud by fund’s adviser.
