Overview

Burns & Levinson has been successfully representing charter schools and related tax-exempt foundations for over 15 years.  By combing the legal experience and industry knowledge available across our full-range of service areas, Burns & Levinson attorneys have the resources and experience to assist charter schools in navigating through a continually-changing and complex legal and regulatory landscape.  Whether related to entity formation, board and governance matters, organization of 501(c)(3) supporting foundations, regulatory and compliance concerns, facility development and real estate, or labor and employment issues, we have the depth and breadth of legal experience to provide effective legal counsel.  Most importantly, we understand the nuances associated with these special institutions and are able to effectively guide schools through legal issues not faced by traditional public or private k-12 schools.

Our attorneys work directly with senior management, trustee boards, and administrators to provide pragmatic legal advice and effective representation in a wide variety of matters.  In addition to representing charter schools and related tax-exempt foundations, many of our attorneys have held board positions with schools, colleges, and other educational organizations.  Our attorneys are active and engaged leaders serving as trustees, school committee members, leaders in alumni organizations and in other similar capacities.

Experience
  • Represented Roxbury Charter High Public School through founding process and established related foundation, forming Massachusetts chapter 180 corporation that qualified for exemption under Internal Revenue Code §501(c)(3).  Represent school in employment, procurement, contracting and education law and real estate leasing, finance and acquisition.  Represent school in bank line of credit and provide legal opinions and board votes in connection therewith.  Serve as counsel to the board, preparing board packages, board votes and minutes.
  • Represent Boston Collegiate Charter School in real estate and governance matters; represented school in leasing and real estate acquisition, including negotiation of purchase and sale agreement, mortgage loan financing; represent school in review of contracts, including real estate leases and construction contracts, and in negotiation with architects, contractors and consultants.
  • Represent Prospect Hill Academy Charter School in real estate and leasing matters, project financing, procurement of design and construction services, and procurement of goods and services.
  • Represented a commonwealth charter school in connection with all aspects of school operations including administrative matters, labor and employment, real estate, leasing, facilities, litigation, commercial agreements, and governance; established 501(c)(3) supporting foundation.
