We are kicking off the Fall with a two-month series focused on special needs planning, guardianships, and conservatorship issues. We will explore special needs trusts and then dive into guardianships and conservatorships, including filing requirements for guardianships and conservatorships, who is entitled to notice of such proceedings, and how to obtain an emergency appointment for a temporary guardian or temporary conservator. We will also discuss the obligations and reporting requirements of the guardian or conservator once appointed and how to expand statutory authority as needed, such as for Rogers authority or to perform estate planning for the incapacitated person. In late October, and in the spirit of back to school, we will return to law school by introducing a fact pattern that we will use to “issue spot” various complex legal issues throughout our November and December blogs, and “Beyond.”
