Overview

In over a decade as a litigator, Andrea Martin has represented individuals and corporations small and large in prosecuting or defending claims. Andrea appears before countless administrative agencies, Massachusetts state courts, Massachusetts federal court and the appeals courts.

In her civil litigation practice, Andrea represents both corporate entities and individuals in all stages of dispute resolution from initial consultation, administrative proceeding, negotiation and mediation, and court proceedings. Her practice covers a variety of business torts, including misrepresentation and fraud, and contractual disputes, including issues in contract formation, interpretation, performance and payment.

Andrea’s labor and employment practice involves advising clients on all forms of termination and discrimination claims, independent contractor status disputes, enforcement and interpretation of non-compete agreements, and wage and commission disputes. Andrea represents both employees and employers in disputes before the Massachusetts Commission Against Discrimination, Massachusetts Labor and Workforce Development Organization and the Massachusetts state courts.

Andrea’s practice has also focused on condominium trust disputes, residential property construction and disclosure disputes, commercial and personal evictions proceeding and white collar criminal defense investigations.

Experience

  • Overturned $6M judgment wrongfully entered against ex-husband in federal court.
  • Secured $1M pre-judgment security in breach of contract matter involving luxury hotel and condominium development project.
  • Successfully defended and negotiated favorable resolution for family-owned business in simultaneous wage and hour, union and wrongful termination government investigations.
  • Second-chaired trial with full vindication of executive accused of over-paying himself in breach of contract and breach of fiduciary duty.
  • Evicted former boyfriend of elderly woman who had lost her capacity to take care of herself and moved into assisted living facility to enable her children to sell the $1M family home.
  • Obtained judgment for corporation against former employee’s six-figure wage & hour claim.
